You must be at least 18 years old and legally able to enter into contracts to use NexCom.

If you are using NexCom on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

NexCom is a business platform that provides tools for:

• Messaging and communication management
• Customer relationship management (CRM)
• Automation and AI-assisted interactions
• Integration with third-party platforms such as WhatsApp, Facebook, and Instagram

Features may change or evolve over time.

You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activity that occurs under your account

You must notify us immediately of any unauthorized use.

You agree not to use NexCom to:

• Violate any applicable laws or regulations
• Infringe intellectual property or privacy rights
• Send spam, malware, or abusive content
• Harass, threaten, or exploit others
• Use the platform for fraudulent or deceptive purposes
• Circumvent platform limits, security, or safeguards

We reserve the right to suspend or terminate accounts that violate these rules.

NexCom integrates with third-party services (e.g., Meta platforms). You acknowledge that:

• Your use of those platforms is governed by their own terms and policies
• NexCom is not responsible for third-party outages, changes, or restrictions
• Platform availability and features may change without notice

Your use of NexCom is also governed by our Privacy Policy, which explains how we collect and process personal data. By using the Services, you consent to data processing as described in that policy.

All NexCom software, trademarks, logos, and content are the exclusive property of NexCom Latam S.A.S. or its licensors.

You may not copy, modify, distribute, or reverse-engineer any part of the Services without prior written consent.

We strive to provide reliable service but do not guarantee uninterrupted availability. We may:

• Perform maintenance
• Modify or discontinue features
• Temporarily suspend access for technical or security reasons

Some services may require payment. If applicable:

• Fees are described at the time of purchase
• Payments are non-refundable unless otherwise stated
• We may update pricing with reasonable notice

You may stop using NexCom at any time. We may suspend or terminate access if:

• These Terms are violated
• Required by law or platform providers
• There is risk to NexCom, users, or third parties

Upon termination, your right to use the Services ends.

To the maximum extent permitted by law, NexCom shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Issues caused by third-party platforms or integrations

Use of the Services is at your own risk.

You agree to indemnify and hold harmless NexCom from claims arising from:

• Your misuse of the Services
• Violation of these Terms
• Violation of applicable laws or third-party rights

We may update these Terms from time to time. Updated versions will be posted on this page with a revised "Last updated" date. Continued use of NexCom means acceptance of the updated Terms.

These Terms are governed by the laws of Colombia, without regard to conflict-of-law principles.
